The NBA legend Testifies He Felt No Fear of the Racing Body in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his drive to win and novelty within the sport motivated his push for 23XI Racing to confront Nascar over alleged violations of antitrust rules.

Team Investment and a Competitive Drive

The owner disclosed financial and corporate details of his racing venture, revealing he invested $40 million of his own funds into the Cup Series operation co-founded with partner Polk and driver Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “I was a new person, I had no fear. I believed I could take on Nascar as a whole. I felt as far as the sport it needed to be looked at through a new lens.”

The Core Dispute: Charter Agreements and Contract Pressure

At issue is the end of a 2016 deal where Nascar provided each team a franchise. This system mirrors other professional sports with separately owned franchises, such as the Charlotte Hornets or the Carolina Panthers. This deal was set to expire in 2024 when Nascar insisted on charter membership renewals.

Jordan was on the witness stand for about sixty minutes and left the court to pandemonium, with onlookers and reporters clamoring for a glimpse or a picture of the global icon.

Spearheading the Fight

23XI Racing is at the forefront of the push along with another racing team for Nascar to overhaul a operating model Jordan contended is unlawful to maintain excessive control.

The team owners reached out to Nascar about possible changes or extension options. Nascar refused to engage, Jordan said.

But in the end, the pushback against what he saw as a unsustainable system was mostly about the usual bottom line for Jordan: Winning.

“Hamlin persuaded me adding a third car improved our chances to win,” he testified, sharing that he bought a third charter late in 2024 for $28 million amid the legal dispute. “So I took the plunge.”

Gibbs described her push for indefinite franchises, submitted in a written letter to Nascar. She said the timing of the contract signing demand didn’t sit well.

She said, the team founder first tried to call and persuade Nascar against demanding signatures, but CEO Jim France refused the appeal.

“Don’t do this to us,” Heather Gibbs said was the message to Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If there are 30, that’s the number.”
